Terms of Service

1. Agreement to Terms

By accessing or using CuzRacecar ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the App.

CuzRacecar is developed and operated by EMSERO, LLC.

2. Subscription Terms

2.1 Plans

• Free tier — 1 team, 5 members, 2 vehicles, 10 races. All features included.
• Full access — $9.99/month or $99/year. Unlimited teams, members, vehicles, and races.

There is no feature gating. Free and paid users have access to the same features; only usage limits differ.

2.2 Billing

• Subscriptions are billed annually.
• Automatic renewal unless cancelled before the renewal date.
• Cancellation takes effect at the end of the current billing period.
• Refunds are handled on a case-by-case basis within 30 days of purchase.

2.3 Price Changes

We may change subscription pricing with at least 30 days notice. Existing subscribers keep their current rate until their next renewal.

3. User Accounts

3.1 Registration

• You must provide accurate information when creating an account.
• One account per person.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to create an account. Users under 18 require parental consent.

3.2 Account Roles

Accounts may hold one or more roles within a team:

• Team Owner
• Team Member
• Driver
• Crew
• Fan / Family

Roles are assigned by team owners and determine what actions a user can take within a team.

3.3 Account Termination

• You may delete your account at any time.
• We may suspend or terminate accounts that violate these terms.
• Upon termination, your data is retained for 90 days (read-only) before permanent deletion, per our Privacy Policy.

4. Acceptable Use

4.1 Permitted Use

• Managing your racing team and its activities
• Logging race results and tracking standings
• Tracking expenses, payouts, and sponsorships
• Sharing updates, photos, and achievements with your team
• Purchasing merchandise through the CuzRacecar shop

4.2 Prohibited Use

• Unauthorized access to other users' accounts or data
• Uploading harmful, illegal, or offensive content
• Interfering with the App's operation or infrastructure
• Using the App for any illegal purpose
• Scraping, crawling, or automated data collection without permission

5. Data Usage

5.1 Data We Collect

• Account information (name, email)
• Team and racing data (results, expenses, standings)
• Photos uploaded by users
• Device tokens for push notifications
• Usage analytics

5.2 Data Storage and Retention

• Data is stored securely on AWS infrastructure.
• Active accounts retain all data indefinitely.
• Lapsed accounts retain data in read-only mode for 90 days.
• Deleted accounts have data permanently removed after 90 days.

5.3 Data Sharing

• Team data is shared with team members based on their roles.
• We do not sell user data to third parties.
• We use Stripe for payment processing and Printful for merchandise fulfillment; these services receive only the data necessary to complete transactions.

6. Intellectual Property

6.1 App Content

CuzRacecar, its design, code, and documentation are the intellectual property of EMSERO, LLC. All rights reserved.

6.2 User Content

• You retain ownership of content you create (photos, updates, team data).
• By uploading content, you grant EMSERO, LLC a license to store, display, and transmit that content as necessary to operate the App.
• You are responsible for ensuring you have the right to upload any content you share.

7. Liability

7.1 Disclaimer

CuzRacecar is provided "as is" without warranty of any kind. We do not guarantee uninterrupted service, data accuracy, or fitness for any particular purpose.

7.2 Limitation of Liability

To the maximum extent permitted by law, EMSERO, LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

7.3 Racing Disclaimer

CuzRacecar is a team management and record-keeping tool. It does not provide real-time telemetry, safety monitoring, or track-side guidance. All racing activities are undertaken at your own risk. Always follow track regulations and safety procedures.

8. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or in-app notification. Continued use of the App after changes constitutes acceptance of the updated Terms.

9. Termination

9.1 By You

You may stop using the App and delete your account at any time.

9.2 By Us

We may suspend or terminate your access for violation of these Terms, non-payment, or if we discontinue the service (with reasonable notice).

10. Governing Law

These Terms are governed by the laws of the State of Georgia, United States. Any disputes shall be resolved in the courts of Georgia.
